Gary L. Francione is an American legal scholar known for his work on animal rights theory, and was the first academic to teach it in an American law school. His work has focused on three issues: 1) The property status of animals, 2) The differences between animal rights and animal welfare, and 3) A theory of animal rights based on sentience alone, rather than on any particular characteristics
Animal welfarism, also known simply as welfarism or "animal welfare" is the position that it is morally acceptable for humans to use non-human animals, provided that adverse effects on animal welfare are minimized as far as possible. Welfarism is often contrasted with the animal rights and animal liberation positions, which hold that animals should not be used by humans, and should not be regarded as their property. On the other hand abolitionism within the animal rights movement is the idea that focusing on animal welfare reform not only fails to challenge animal suffering, but may prolong it by making the exercise of property rights over animals appear acceptable. The abolitionists' objective is to secure a moral and legal paradigm shift, whereby animals are no longer regarded as things to be owned and used. [Animals as Property by Gary L. Animal welfare theories accept that animals have interests but allow these interests to be traded away as long as there are some human benefits that are thought to justify that sacrifice.Animal rights means that animals, like humans, have interests that cannot be sacrificed or traded away just because it might benefit others. (However, the rights position does not hold that rights are absolute; an animal’s rights, just like those of humans, must be limited, and rights can certainly conflict.) Animal rights means that animals are not ours to use for food, clothing, entertainment, or experimentation.
Animal welfare allows these uses as long as “humane” guidelines are followed. The difference between animal rights and animal welfare has been summed up like this: Animal rights advocates are campaigning for no cages, while animal welfarists are campaigning for bigger cages. Animal rights supporters believe that it is morally wrong to use or exploit animals in any way and that human beings should not do so.
Animal welfare supporters believe that it can be morally acceptable for human beings to use or exploit animals, as long as: the suffering of the animals is either eliminated or reduced to the minimum and there is no practicable way of achieving the same end without using animals. For people who think like this, the suffering to animals is at the heart of the issue, and reducing the suffering reduces the wrong that is done. Temple Grandin is an American academic and animal behaviorist and a prominent proponent of the humane treatment of livestock for slaughter. She is the author of many scientific papers on animal behavior and a consultant to the livestock industry, where she offers advice. She is also an autism spokesperson. In a paper presented at a discussion on whether animals should be property she says: "Animals are not things and Animal Welfare is based on Neurological Complexity. But animals can be property and still have many laws and other protections to insure their welfare. Changing language based concepts like 'property' are only important to animals if changes in rhetoric cause people to treat animals better. I have little interest in rhetoric unless it provides actual changes where the animals live. All my life I have worked, making concrete improvements out in the field". Animal rights and animal welfare are both highly complex topics, which involve concepts in philosophy, history, science, and law. Based on an article about integrating animal interests into our legal system, many in the animal rights movement believe that as long as animals remain as legal property, their interests cannot be accommodated within the legal system. Property law can be transformed such that ownership is redefined as guardianship, allowing animals to achieve the legal respect that animal rights proponents believe they deserve. There is a broad spectrum of views and beliefs about this issue. Hence, the take-home message is to recognize that 1) animal welfare and animal rights are not the same, and 2) it is important for us to be open-minded to new perspectives, putting aside our preconceived notions and actively explore new ways of thinking.
